Corporate Manslaughter

The landmark Corporate Manslaughter and Corporate Homicide Act 2007 came into force on 6 April 2008.

This new legislation means that companies and organisations can legally be found guilty of corporate manslaughter as a result of serious management failures
resulting in a gross breach of a duty of care.

Organisations must take relevant duty of care for employees; ensuring they provide employees with the correct equipment to carry out their duties correctly.

In regards to access equipment, the correct equipment for the task must be made available. Equipment must be fit for the intended purpose and in good condition. Companies and their Directors can be found liable if this is not adhered to.
